Barcelona wins Messi's Olympic games case

The Court of Arbitration for Sport has upheld today the appeals filed by Schalke, Werder Bremen and Barcelona against the decision issued on 30 July 2008 by the Single Judge of the FIFA's Player’s Status Committee (read more here) that consequently has been set aside in its entirety.

Barcelona therefore doesn't have to release Messi for the Olympic football tournament and could call him back.

This is the press release issued by the Court of Arbitration for Sport:

The Court of Arbitration for Sport (CAS) has upheld the appeals filed by FC Schalke 04, SV Werder Bremen and FC Barcelona against the decision issued on 30 July 2008 by the Single Judge of the FIFA's Player’s Status Committee that consequently has been set aside in its entirety.

The FIFA decision challenged in appeal concluded that the release of players under the age of 23 for the Olympic Football Tournament Beijing 2008 was mandatory for all clubs on the basis of a long lasting and undisputed practice which had become a customary law for the clubs.

After this decision, on 31 July 2008, FC Schalke 04, SV Werder Bremen and FC Barcelona filed an appeal with the CAS. The appeals were joined and referred to the same Panel, which was constituted as follows: Mr Efraim Barak, Attorney-at-law (Israel), President, Mr Michele Bernasconi, Attorney-at-law (Switzerland) and Mr Ralph Zloczower, Attorney-at-law (Switzerland).

The CAS Panel, on the occasion of a hearing held on an urgent basis in Zurich on 5 August 2008, reviewed all arguments presented by the parties and reached the following conclusions:

- The Olympic Football Tournament Beijing 2008 is not included in the Coordinated Match Calendar and there is no specific decision of the FIFA Executive Committee establishing the obligation for the clubs to release players under 23 for this tournament.


- The requirements to justify a legal obligation of clubs to release their players for the Football Tournament Beijing 2008 on the basis of customary law are not met. Accordingly, the Panel concluded that FC Schalke 04, SV Werder Bremen and FC Barcelona had no legal obligation to release the players Rafinha, Diego and Messi, respectively, for the Olympic Football Tournament Beijing 2008.

However, this decision does not affect the eligibility status of the players who have been validly entered by their National Olympic Committee and who remain fully eligible to compete in the Olympic Games of Beijing 2008.

In view of FIFA’s recommendation made to the clubs to release their players as well as of the Olympic spirit, the CAS call upon the good will and good sense of FIFA and the clubs to find a reasonable solution with regard to players who wish to represent their country in the Olympic Games.

pep's opinion:
first of all congratulations to barcelona's judicial advisors. clubs go before countries as i'm concerned but don't make messi return now. we don't need him in the champions league qualifying games, he'll be equally fit if he plays some games there or plays them with us, the player would love to take part in the olympics and this is one of those little things that could upset the player immensely and that could break something permanently in his relation with the club. just make a statement saying something like "now we know this for the next time and before the 2012 olympic games we're going to sit around the table with all the clubs and adopt a joint stand about not releasing any of our players"

I saw on eurosports now messi making his way back to join the barca team. he didnt look happy tho.
I wonder why we wouldnt let him play the olympics. We should beat whoever we get to progress to the UCL group stage. I saw Diego and R80 watching their ladies play Germany and their clubs havent told them to come back yet. I hope this is not the begining of the end btw us and MESSI

You're sure about him leaving China cause the decision was just two hours ago so how can they arrange everyting already, flights and stuff?

Anyway, would be a mistake to call him back!

very sure. Barca knew d decision was due today so they must have made arrangements. Well what i saw was Messi alone guarded by over 8chinese police into a bus that took him alone. So where would he be going without his team mates?
I might be wrong but i believe he was jetting back to the barca team. I fear for us. We dont really need this guy for these 2 qualifiers. I hope R80 doesnt whisper to him "thats how they reward their stars"....

yeh not a fan of this..we cant afford messi to be in bad mood with us..+ with our team atmo we dont need him for these qualifiers. they should have let him play. we need him mentally on our side.
Wel see what happens but in not too pleased abt this

if barca can not win any important match without messi,that is bad.we should learn not to depend on any player.what of he is injured during the season?so that will be the end of barca?too bad!!!.great teams do not depend on a player.

Guardiola said that Barca need to ensure Messi is happy. Happy Messi should mean better performance on pitch. They should let him play at Olympics. Only worry is risk to injury. They should reach a deal with Messi & Argetnia FA so he doesn't have to play meaningless friendlies in South America, only offical qualifiers. its inderstandable he wants to play. Gold medal awaiting.

NOUBARCA: you probably saw images of him arriving in China. Barcelona hasn't yet taken an official stand about Messi returning or not, they just say they're happy with the legal victory.

If the call him back it will harn his form,the only thing he could think of is how they all use there STARS and then dicht them out like they did to the others like romario,maradona,ronaldiho... i hope he does not get that idea or otherwise no messi next season, and if the board decised to call him back, another blind mistake of the board

2. We cant even win against a 3rd rate team to qualify for the CL without messi.

Why are you ppl so negative!??!?! Messi is where he is today in world football because of Barca. He wouldnt even be a professional football player if Barca had not taken him in and made sure he grew physically. He is not going to leave the club because we did not let him play in the Olympics (an AMATEUR competition). Im sure he wants to play but i severely doubt that if we forced him to come back he would hold it against the club for too long. All that being said i do not even think they are going to make him return.

Yes its highly unlikely that he will leave over this but when small things add up, we'll never know what happen.

Is there a point in making him unhappy over a 3rd grade team that we should walk over without sweating?

Let Messi play in the Olympic and we'll bring out the best out of the others. No worry with Hleb and Xavi in the midfield. Hleb will do well I believe.

I hope they do what every reasonable club would do. I don't see any good reason to get him back. They've won the case, we'll be able to use this decision later on, now they should shown themselves worthy winners and do the sensible thing.

I'm calling bullcrap on this one. We should have won the case, then told Messi he could stay.

We don't need Messi to dispatch our Champions League opponent. Messi is happy, we win something like 14-1, and are in the group stages. Messi tears it up in the Olympics, comes home and sells lots more shirts thanks to the international exposure, and all is right in the world.

I know that the new regime wants to make clear that nobody has special circumstances, etc, and I'm all for that. But there should be a way to do that, and keep your star player happy.

All we had to do was shrug our shoulders, say "Well, we tried," and left it alone.

I don't think it would be wise for Barcelona to call back Messi at this point. It would be a much different story if the verdict had been rendered before Messi departed for China, but now that he's gone let him be. Calling him back now would severely piss him off and frankly Barcelona don't need him right now.

At least Barcelona won't have to deal with this "issue" again with Messi because "if" there is a next time Barcelona will be well within their right to say NO!

pls just keep him happy. yes the club is more than one player but this player is the best in the world, if messi left because of some stupid technicality like tyis then they should line up the board and shoot them. with the greatest respect to both jerusalem and wisla we should not rely on one player to win any match, let messi play sat the olympics he is just as likely to get injured playing for them as us and it will keep him happy.
